https://video.megaphone.news/videos/watch/551bd470-e15f-4e3f-ab85-eba6dcac432d «شفنا إنّه بطّل في توازن، فاجتمعنا تنعيد التوازن للسلطة القضائية». هكذا حاول رئيس الحكومة نجيب ميقاتي تبرير خرقه مبدأ فصل السلطات في اجتماع مجلس الوزراء الذي عقده اليوم بهدف «وضع آلية للتعاطي القضائي مع ملف المصارف»، متذرّعاً بالفقرة «ه» من مقدّمة الدستور التي تُنادي بالتعاون والتوازن والتكامل بين أدوار السلطات. لكنّ السعي لـ«التكامل» بين السلطات لم يمنع ميقاتي من تقديم السلطة التنفيذيّة كوصيّ على السلطة القضائيّة، فسمح لنفسه انتقاد «الخلل في مسار القضاء» تجاه القطاع المصرفي. وفي محاولة لاستمالة أكثريّةٍ إلى جانبه، وضع رئيس الحكومة الحجوزات التي أُلقيَت على بعض المصارف في سياق هجوم كبار المودعين عليها، كي يحصلوا على أموالهم من درب صغار المودعين. الجدير بالذكر أنّ جلسة الحكومة تزامنت مع وقفةٍ احتجاجيّة أمام مدخل السرايا، ندّد فيها المحتجّون بدفاع الحكومة عن المصارف وطالبوا باستعادة ودائعهم التي أكّد ميقاتي أنّها «مضمونة عند الدولة». “We noticed an imbalance in the judiciary, so we met to restore it.” PM Najib Mikati attempted to justify his violation of the principle of power separation, in a Cabinet session held today. The session aimed to “put in place a mechanism for judicial handling of banks,” evoking Section E of the Constitution Preamble, which mentions “the principle of separation of powers, their balance and cooperation.” However, he also presented the executive authority as the guardian of the judiciary, criticizing the “flaws in the judiciary’s dealings” with the banking sector. Mikati claimed that large depositors who want to retrieve their money at the expense of small depositors were behind the freezing of some banks’ assets.
